John Muir Health MyChart Mobile Messaging Supplemental Terms and Conditions

 

When you sign up for John Muir Health (JMH) MyChart Mobile Messaging, these JMH MyChart Mobile Messaging Supplemental Terms and Conditions supplement and are part of your agreement to the Terms and Conditions for JMH MyChart and JMH’s Website Privacy Policy

Supplemental Agreement

BY OPTING INTO JMH MYCHART MOBILE MESSAGING, YOU ARE EXPRESSLY SIGNIFYING YOUR AGREEMENT TO AND ARE BOUND BY THESE JMH MYCHART MOBILE MESSAGING SUPPLEMENTAL TERMS AND CONDITIONS IN ADDITION TO AGREEING TO JMH’S MYCHART TERMS AND CONDITIONS AS WELL AS JMH’s WEBSITE PRIVACY POLICY. IF YOU DO NOT AGREE, YOU ARE NOT AUTHORIZED TO USE JMH MYCHART’S MOBILE MESSAGING.

You agree to receiving unencrypted mobile messages, including text messages. You understand and agree that any person with access to your mobile device may be able to see these notifications, and any person with access to your mobile messages will be able see these notifications. Please take these factors into account when providing a phone number as part of opting into JMH MyChart Mobile Messaging:

    • Notifications related to your visits at a JMH or affiliated locations. If you would like to opt out of receiving text messages concerning visits, please change your communication preferences in your JMH MyChart account or reply STOP to the text.
    • Notifications related to John Muir Health MyChart. These messages will not contain specific details about your health, but may include general status updates about your care. For example, this includes, but is not limited to, alerts that a new After Visit Summary or test result or billing notification is available in your JMH MyChart. If you would like to opt out of receiving such text messages, please change your communication preferences in your JMH MyChart account or reply STOP to the text.
    • One-time passcode sent to you after you have opted into receiving such a code to authenticate your logging into JMH MyChart. If you would like to opt out of receiving such text messages, please change your communication preferences in your JMH MyChart account or reply STOP to the text.
    • Billing notifications from JMH.  Related to payment notices, billing notifications, or any transaction with JMH. If you would like to opt out of receiving such text messages, please change your communication preferences in your JMH MyChart account or reply STOP to the text.
    • Notifications related to prescription reminders. If you would like to opt out of receiving such text messages, please change your communication preferences in your JMH MyChart account or reply STOP to the text.
    • Notifications related to care management. If you would like to opt out of receiving such text messages, please change your communication preferences in your JMH MyChart account or reply STOP to the text.

You agree and verify that any phone information provided to JMH for use with JMH MyChart Mobile Messaging is true and accurate, and that you are the current subscriber or owner of any telephone number that you provide. You further agree to maintain the confidentiality of the messages sent through or received from JMH MyChart Mobile Messaging, including by taking appropriate steps, such as having multifactor authentication in place on your mobile device. 

By providing your telephone number(s), you agree to receive MyChart Mobile Messages from JMH, its affiliates, agents, associates, or independent contractors. You acknowledge and agree that text messages may be sent to your telephone number(s) even if telephone number(s) is/are registered on any state or federal Do Not Call list. You agree to receive messages from JMH, its affiliates, agents, associates, or independent contractors, even if you cancel or terminate your relationship with us, except if you opt-out.

Carriers and Carrier Costs and Message Data Rates 

Message and data rates may apply for any messages sent to you from or on behalf of JMH or its affiliates, agents, associates, or independent contractors, and messages you sent via the JMH MyChart Mobile Messaging. You agree to pay such charges. Message frequency may vary.

Opting Into or Out of or Getting Help with JMH MyChart Mobile Messaging

You may opt into JMH MyChart Mobile Messaging at any time by logging onto your JMH MyChart account and updating your preference on the Manage Text Subscription Page (accessible from the Communication Preference page) or by contacting your provider’s office and requesting to opt in. You may also opt into JMH MyChart Messaging by texting HELP to the short code for instructions.

To stop receiving SMS from JMH MyChart Mobile Messaging, please change your communication preferences in your JMH MyChart account or reply STOP to the respective short code. Your opt-out request will generate one final message confirming that you have been unsubscribed. You will no longer receive SMS messages from the short code you opted out from.

At any time, you may communicate your desire to not receive additional messages from JMH MyChart Mobile Messaging by replying STOP to the message or changing your communication preferences in your JMH MyChart account.

JMH Revisions

You agree that JMH may: (1) change or update the JMH MyChart Terms and Conditions; (3) change or update these JMH MyChart Mobile Messaging Supplemental Terms and Conditions; and/or (4) JMH’s Website Privacy Policy. You also agree that you will regularly review each of these referenced terms and conditions as well as policy, and that your continued use of JMH MyChart Mobile Messaging will signify your agreement thereto.

Limitations on Liability

Carriers are not liable for delayed or undelivered messages.

JMH, and its affiliates, agents, associates, or independent contractors are not liable for delayed or undelivered messages.

Applicable Law

These JMH MyChart Mobile Messaging Supplemental Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California. You agree that venue for any dispute, controversy or claim arising out of or related to these JMH MyChart Mobile Messaging Supplemental Terms and Conditions shall be the County of Contra Costa, California.
